The parent or legal guardian will then have the authority to do whatever is legally necessary to make the claim, including negotiating a settlement or starting and prosecuting a lawsuit if settlement is not possible. Once resolution of the claim is achieved, the parent or legal guardian must petition the court for approval of the resolution. Once the court grants its approval, the funds received are placed in a court supervised interest bearing account until the child reaches the age of majority. There are some circumstances that allow parents to recover their out-of-pocket expenses associated with their child’s accident before the money is placed into the court supervised account.
